Street Parking
A car parked on the street, in front of a house, isn't a violation of anything. Here's what Westwind's governing documents actually say, so the board has one place to point to when this comes up.
The Short Version
The streets inside Westwind are county streets, not private property, and not owned by whichever house happens to be nearest. Under the Declaration, a private automobile is explicitly allowed to be parked there. Nobody needs permission to park a normal car on a public street, whether or not it's directly in front of your own house.
What's Actually Restricted
The Declaration doesn't say anything special about parking directly in front of a house. What it does restrict is specific vehicle types, not where a private automobile can park.
“No commercial truck, commercial bus, or other commercial vehicle of any kind, or any boat, boat trailer or recreational vehicle of any kind shall be permitted to be kept upon any portion of the Properties, except as approved by the Architectural Control Committee.” Declaration of Covenants, Conditions and Restrictions, on commercial vehicles and RVs
“No portion of the Properties shall be used for the repair of automobiles, trucks, motorcycles, vans or any other type of motor vehicle, nor shall any vehicles other than a private automobile be parked on any portion of the Properties. No unlicensed vehicle shall remain on the Properties for more than seventy-two (72) hours.” Declaration of Covenants, Conditions and Restrictions, on vehicle repair and unlicensed vehicles
What This Means in Practice
These Are County Streets
The 2012 ACC Guidelines confirm the streets themselves are public right-of-way, maintained under county authority, not private Westwind property:
“Per Montgomery County Code and HOA covenants, commercial vehicles are prohibited on your property (with the exception of your garage) and on county streets adjacent to homes or schools.” 2012 ACC Guidelines
Note this restriction, like the Declaration's, is specifically about commercial vehicles. It doesn't restrict where an ordinary personal car can park on a public street.
What Actually Needs a Report
A Neighbor's Car on the Street
Even if it's not directly in front of their own house. Public streets aren't assigned parking.
A Commercial Vehicle, Boat, or RV
Kept on a driveway, lawn, or street without ACC approval on file.
A Car That Hasn't Moved in Weeks
Possibly unlicensed and past the 72-hour limit; worth flagging to the board.
